REQUIRED DOCUMENTS FOR TRADEMARK RENEWAL

  • A duplicate of the registration document.
  • Copy of TM – A form (form used for the original form for registering the trademark).
  • Proof of the applicant’s identity and address.
  • The applicant may have the power of attorney, in case they are an authorized representative or agency.
  • Bringing a Trademark back.

According to the Trademark Act of 1999, under Section 25 (4), it is permissible for restoration of a trademark, which enables anyone to submit applications.

PROCEDURE FOR RENEWAL OF TRADEMARK

  • Trademark search :Before the renewal of trademark, proprietor must ensure that there will be no similar trademarks present or identical mark has been filed. A brand enquiry can be done, on the webpage of the Indian Trademark Office.
  • Application for Renewal :In case of submitting the application either 6 months before or 6 months after it has expired, by spending an extra charge, the renewal can be done directly at the Trademark Office or by going through online website of the Indian Trademark Office.
  • Application Review :For making sure that all required information has been given or not, the trademark office will review the renewal application after it has been submitted.
  • Publication or Trademark Journal :After all the above steps, the brand will be promoted in the Trademark Journal.
  • Opposition Period :Third parties may oppose the extension of the trademark, during the 4 months following date of publishing in the trademark journal.
  • Certificate of renewal :A certificate of renewal will be given by the trademark office, in case of 0 resistance.
  • Payment of fees :In order to complete the renewal procedure, fees must be paid which is almost the last stage. The payment of fees can be made directly to the Trademark Office or by electronically through the website of the Indian Trademark Office.
